  EUREKA -- A proposed law that would make it illegal to have a cat or dog
older than 4 months that is not fixed is again being considered Tuesday by
the Humboldt County Board of Supervisors.

  The ordinance came to the county Board of Supervisors with the
enthusiastic support of the county's animal welfare community, who to a
large degree are the ones who deal with pet overpopulation.

  The proposed ordinance reads as follows: ?No person shall own, harbor, or
keep within the unincorporated area of the county a dog or cat over the age
of four months which has not been spayed or neutered, unless the dog or cat
is exempt.?

  If the ordinance is adopted, exceptions would apply to canine cops;
trained search-and-rescue animals; dogs and cats trained as service animals,
such as guide dogs; dogs or cats that have a health reason for not being
fixed; herding or hunting dogs with skills that need to be documented;
licensed kennels; and dogs or cats that are registered with the American
Kennel Club, the United Kennel Club, the American Dog Breeders Association,
the Cat Fancier Association or another recognized registry.

  The first offense would be punishable by a fine of up to $100. The second
offense, if in

  the same year, would levy a fine of up to $200. The third strike, if again
in the same year, would be punishable by a fine not to exceed $500.
  The fourth violation in a year would be considered a misdemeanor and could
carry a fine of up to $1,000 and up to six months in jail.

  The issue was considered in April, but the three supervisors in attendance
voted after taking testimony to put the issue off until the other two
supervisors could attend.

  Humboldt County Sheriff Gary Philp has said the new law, if adopted, would
give his department one more tool to deal with the problem of pet
overpopulation. It doesn't mean deputies will be looking over the fences of
everyone in the county to make sure their pets are fixed, he said.

  Opponents of the proposed law say it would disproportionately affect
poorer dog owners, who can't afford to pay to purchase pure bred animals.

  The meeting starts at 9 a.m. in the Humboldt County Courthouse.


  Exceptions to the ordinance

  *Canine cops

  *Trained search-and-rescue animals.

  *Dogs and cats trained as service animals, such as guide dogs.

  *Dogs or cats that have a health reason for not being fixed.
