I know this is off the original topic but I was in the court room of the
highest court in the largest state in the country. It truly touched me to see
Evan fight seven California Supreme Court Justices and the attorneys on the
other side I can not imagine the pain of losing a child. In my eyes nothing
compares to what Evan did for the family that lost their child to a senseless
tragedy whether we know it or not we have an effect on others, either positive
or negative. I will never forget that day in court. Ed Hill

I'm taking this position: a judge should not be making laws, that is the
job of the city council or the town residents.
A judge interprets the laws. If a judge makes a mistake in law, a higher
court, (court of appeals) can consider and change the decision. Another
judge on the same level, can't overturn another judge. If that happened
there would be no end to decisions.
The Court of Appeals cannot decide the credibility of a witness. That is
always left to the judge who heard and evaluated the evidence.
If the judge failed to follow the law, the Court of Appeals can overturn
the decision, send it back to the original judge with instructions, or
sustain the lower court decision. The Court of Appeal is set up to affirm the
lower court.
I have won about 80% of my appeals, but that is only because I only appeal
a case if I think I can win. The last decision I argued at the California
Supreme Court, I lost in the lower court, took it to the Court of Appeals
and reversed that decision and won at that level. Then the defendants
appealed it to the Supreme Court. The Supremes overturned the Court of
Appeals
and agreed with the lower court. But, it was on a point of law. The
question was if the land owner of a school yard would be responsible for the
death of three children from a driver who wanted to kill children.
There was law on my side, but also there was law on the other side as well.
I liked the decision of the Court of Appeals best. If anyone wants to
read the case it is Weiner vs South Coast Childcare Center. It is some
interesting California law.
There were some of the dog people there as well for the argument. It was
fun.
