I appreciate your post, Evan. However, seeing how your message was posted to
"give the other side of the story," I would appreciate certain "gray" areas
being elaborated upon...
For example, you mention that Margy is only doing what she must do in order to
"protect herself." From what *exactly* is she trying to protect herself?
You also stated that Margy brought suit against only those board members "who
attacked her." In what way was she attacked?
Another thing that's not clear to me... You said that "I was asked by
her[Margy] at a national a couple of years ago that she would drop everything,
if the individuals would just leave her alone." Are these individuals the
Board Members who Margy attempted to sue? Are they "not leaving her alone" by
filing counter suits? Or, are they harassing her in another way? If so, how
are they harassing her?
One last thing... You say that "Margy never wanted to sue the club, and only
did so to protect herself. She is not asking for any recovery from the club."
If Margy is not asking for any recovery from the Club, then for what is she
asking?
Please know that I am not passing judgment on either "side" by asking these
questions. I just want to understand what this unfortunate mess is really
about. However, I will admit that I'm having trouble wrapping my mind around
the possibility that the Parent Club/Board Members acted in such a heinous
manner as to cause an individual to file a lawsuit against the Club and certain
Board Members. It's a DOG CLUB, for Pete's sake! Aren't we, The Club,
supposed to be all about the welfare and promotion of the German Shepherd Dog?
Not lawsuits.

On another list I read information regarding the lawsuit against the GSDCA
was granted a reversal in January. After reading that email I posted my

Margy did sue the club and only specific board member who attacked her.
The Florida court decided that Florida had no jurisdiction, and so they
dismissed the case. The Florida Appellate Court reinstated the suit against
the
GSDCA and told Margy that if she wanted to go after the individuals, she had
to sue in New York or the state each of them lived. The individuals she
sued did not have contact with Florida, the GSDCA did
Margy has sent a letter to the club explaining that she never wanted to sue
the club, but had to in order to be protected against what was being done
to her. She has offered to dismiss the action against the parent club, and
it has been presented by Lamar to the board. I understand she is asking for
an acknowledgment of what happened, so that she will be protected if it
happens again. Also, I was told she would want to be reinstated. The
individuals involved have threatened to sue her.
I hope the board understands that Margy did what she did to protect
herself. I was asked by her at a national a couple of years ago that she would
drop everything, if the individuals would just leave her alone. I explained
that offer to the president, and he told me that they intended to go after
her, and would not back off. I was there, so that I know it to be a fact.
At that time, I told Margy that I would no longer be involved and the only
reason I know what is going on is that a few weeks ago Lamar informed me of
the status, since I used to be representing the GSDCA and Margy at
different times.
I expect the board will agree, and the GSDCA will not longer be part of the
litigation. Margy never wanted to sue the club, and only did so to
protect herself. She is not asking for any recovery from the club.
This is a terrible mess, but the GSDCA can now agree to stop what was done
in the past, and move forward. It will take the board's understanding and
agreement, but I have great faith in our board to do the right thing.
