Following the Free Software Movement India's statement on Airtel's act of
inserting malicious scripts into user's browser, Free Software Hardware
Movement, Puducherry strictly condemns this act of Flash Networks Ltd.,
which charged Thejesh, an activist and programmer for exposing its
malicious code to the public.

On June 3, Thejesh GN, exposed that some extra lines of codes originating
from the program developed by Flash Networks Ltd., is being injected into
the user's browser who are on Airtel 3G network. He revealed it by posting
screenshots and some text explaining how the extra lines of code are
inserted every time he visits a webpage. Following this, on June 8, he was
charged by Flash Networks Ltd., with a cease-and-desist order and was
subjected to criminal lawsuit under the IPC 1860 and Information and
Technology Act, 2000. However his act of uploading them to GitHub was
protected by the Section 52(1)(ac) of the Indian Copyright Act 1957. On
June 9, the order was followed by a take down notice to GitHub under the
Digital Millennium Copyright Act of the US.

It is clearly evident that Airtel is violating the principles of data
carriage, net neutrality and user's privacy. This act of Flash Networks
Ltd., is purely an act of bullying an individual and suppressing his/her
rights of online access and privacy.

According to the statement of FSMI, it demands that the Govt. of India
should immediately initiate an inquiry and take action against Airtel for
interfering with the communications of its users on its 3G networks, all
TSP's should be directed to ensure net neutrality and put in place the
privacy of online communications and net neutrality. Against this act of
suppressing user's right to free speech, let us all share the code [1]
widely and protest against this offensive act of Flash Networks Ltd.
