Ron might be right, however, it would likely be dealt with via the legal
system. MVPD carriage of TV stations is assured by the 1984 "must carry" order,
and the 1992 Cable Act that offers the alternative of retransmission consent.
The real issue here is whether MVPD systems would upgrade to support ATSC 3.0
features or simply transcode to MPEG-2 and MPEG-TS - they already use a
different modulation system.
If stations move to IP transport, then the MVPDs can simply make streams
available via their broadband networks or their linear TV networks. Some
systems, like COX here in Gainesville, are already making stations available
via IP over broadband and h.264 encoding.
The order clearly expects that ATSC 1.0 will continue for some period during a
voluntary transition - it remains to be seen how broadcasters will deal with
the need to create a new service without government mandates...
