Yeah I see it too. Most MPEG2 encoders appear to default to shifting the 
picture down one line so that the line 21 captions appear in active video. I 
asked encoder manufacturers about this and was told that this became the 
default before EIA708 DTV closed captioning standards so that legacy EIA608 
could be read.

In the intervening 4 years or so after EIA708 and now that EIA708 is FCC 
mandated, the 1 line dropped default video is still the case even though it is 
not required!

We took the trouble on our DTV transmission to shift the picture up one line to 
conceal the caption line. Many other broadcasters don't seem to bother.
