The antitrust scrutiny of Google, Apple and Intel has reignited a
simmering debate in academic and legal circles over the appropriate
regulation of dominant technology companies.
Put simply: Is antitrust outdated for the Information Age?
There's a growing consensus among experts that power in the industry
accrues too rapidly, dominance is too difficult to gauge, and outcomes are
too hard to predict for traditional regulatory approaches to apply.
But from that starting point, the conclusions diverge sharply.
Some argue that the unforeseeable and often self-correcting nature of
these fast-moving markets, along with the critical role of innovation in
today's economy, demands that regulators rarely take action.
Others, however, believe that the ability of a single technology company
to so quickly lock down a market requires especially rigorous oversight
and a willingness to step in at an earlier stage, before innovative rivals
are elbowed out of the field.
