So for now a growing consensus of Internet service and content providers acknowledges that wireless network operators need flexibility. To ensure service to all customers, for example, some wireless broadband users may not be able to use cell phones to transfer large files or watch high-definition videos.
This kind of network management is not "evil." It's a technical necessity. It doesn't make sense to ban it, or even to put a slow-moving bureaucracy in charge of deciding how to implement it.
Short of imposing new rules and micromanagement, there's plenty the FCC can do to ensure a free and open Internet for wireless broadband users. For more than a year, for example, the FCC has been asking Congress for funds just to compile an inventory of existing licenses, a first step toward freeing up underutilized frequencies for productive use.
That's right -- the agency that regulates the airwaves doesn't know which frequencies it has allocated, or to whom. Before applying more constraints to wireless networks already groaning under consumer demands, why not figure out how to open up more spectrum?
