This is a very positive step in the right direction. The Ministry of the Environment is seeking, by May 2nd 2004, written submissions on its proposal. It will make its final decision with respect to whether SynFuel should be subject to an environmental assessment after it has reviewed all the submissions. The greenhouse gas (global warming and climate change) emissions of the proposed petroleum coke plant are 2.5 times greater than those of a high- efficiency natural gas power plant. Its smog and acid rain-causing sulphur dioxide emissions are 20 times greater. Please contact Robert Nadolny of the Ontario Ministry of the Environment and let him know that you support subjecting the Synfuel proposal to a full review under the Environmental Assessment Act. In particular, please tell Mr. Nadolny that you believe that the environmental assessment should review whether north- western Ontario?s electricity needs can be met by a combination of energy conservation and efficiency, ecologically sustainable renewable electricity sources (e.g., biomass, water power, wind power) and high-efficiency natural gas power plants, instead of dirty petroleum coke. NOTICE OF PROPOSAL FOR REGULATION © Queen's Printer for Ontario, 2004 Proposal Title: Proposal to designate SynFuel Technologies? (SynFuel) proposed petroleum coke electricity generation facility in Thunder Bay under the Environmental Assessment Act (EAA). Regulation or Bill Number: Regulation Short Description: SynFuel Technologies is proposing to construct a 199 Mega Watt (MW) electricity generation facility in Thunder Bay. The proposed facility would run on synthetic gas (syngas) produced through the gasification of petroleum coke. Petroleum coke is created by coking (i.e. heating in the absence of air) the heaviest layer of product produced by oil refineries. It is proposed that petroleum coke for the process will be shipped to the facility from Alberta in rail cars. Purpose of the Proposal: As a result of previous public consultation and the Ministry of the Environment?s notice of proposal to issue an instrument (Certificate of Approval under the Environmental Protection Act ? posted under EBR # IA03E1538 ? see hyperlink at the end of this notice), the ministry received a number of requests to designate this undertaking under the Environmental Assessment Act. As a result of these comments and the ministry?s review, the ministry is posting this notice of a proposal to designate the project under the Environmental Assessment Act. This designation would make SynFuel Technologies subject to the requirements of the Environmental Assessment Act. The regulation will require SynFuel to undergo an individual Environmental Assessment, which includes submission and Ministerial approval of a Terms of Reference for the preparation of an environmental assessment for the undertaking, followed by preparation of an environmental assessment document which will then follow the review and approval process set out in the Environmental Assessment Act. Other Relevant Information: Under Section 3.0.1 of the Environmental Assessment Act, a proponent may volunteer to be designated under the Environmental Assessment Act by entering into a written agreement with the Minister, rather than by regulation. This option was outlined to SynFuel Technologies; however, SynFuel did not choose this option. Other Public Consultation: Proponent: Public meetings were held March 6, 2002 (hosted by Thunder Bay Hydro and Northwest Energy Association) and June 12, 2002 (hosted by the Science Society of Ontario) with about 150 attendees at each meeting. Public meetings hosted by SynFuel were held September 4 and October 29, 2003 and February 20, 2004. Notification has been given by SynFuel to neighbours in the industrial park, and other meetings have been held with municipal representatives, industry and business managers. On March 1, 2004, SynFuel published a notice in a Thunder Bay newspaper to notify the public that an environmental study prepared by SynFuel was available for review. The notice indicated that the study was available at several locations in the community, as well as on the website of SynFuel?s consultant. Ministry: The Ministry of the Environment conducted public consultation on the Certificate of Approval Application by posting on the Environmental Registry. The thirty day comment period on this instrument occurred from October 31, 2003 to November 30, 2003, resulting in a number of requests to designate the undertaking. Public consultation with regard to the proposed regulation to designate the project has not taken place. The public review period provided for in this notice is your opportunity to comment on the proposed regulation. All comments about the proposal to designate should be directed to the individual identified in this Notice. The ministry has already received substantial information from the public and the proponent about the proposed project. The purpose of this posting is to solicit input about the proposal to make a regulation to designate the project under the Environmental Assessment Act and which, if any, sections of the Act should apply. If the project is designated under the Act, additional opportunities for public consultation will be required of the proponent.
