UNHCR welcomes Ecuador’s new Human Mobility Law

TannerUNHCR welcomes the passing by Ecuador’s National Assembly of a Human
Mobility Law, which regularizes the situation of people on the move - including
refugees, asylum seekers, stateless persons and victims of trafficking. The new
law, unanimously passed by the National Assembly last week, represents a major
step in the protection of refugees and asylum seekers and updates the framework
for the regularization of the status of immigrants, migrants, refugees, asylum
seekers, stateless persons and victims of trafficking and human smuggling, as
well as their families. The law also establishes important principles, such as
equal treatment before the law, not returning people to countries where their
life or basic rights could be threatened (“refoulement”) and the
non-criminalization of irregular migration.UNHCR in particular applauds the
provision in the law which confers refugees a migratory status as residents,
favouring their full integration and thus allowing them to contribute to
Ecuador’s development. Particularly encouraging is that refugees will be
granted a national identification card issued by the Civil Registry. The law
takes into consideration the specific situation of children in need of
international protection, protects stateless persons and proposes measures to
prevent statelessness.In a global context of increasing forced displacement,
Ecuador offers an example of comprehensive protection for all people on the
move, assuming not only its international responsibilities but also enacting
the rights recognized in the Ecuadorian Constitution.UNHCR would like to
reaffirm its commitment to continue supporting the efforts of Ecuador to
strengthen its asylum system. In this regard, we have offered our cooperation
and technical assistance for the development of regulations related to the
Human Mobility Law, as well as other instruments to ensure access to rights for
refugees, asylum seekers and stateless persons.Ecuador is host to over 60,000
refugees, 95% of whom are Colombians. This is the largest refugee population in

político-económica na Venezuela.O decreto presidencial publicado hoje responde
a um pedido do ex-deputado venezuelano da oposição Óscar Pérez, atualmente
exilado no Peru, onde dirige a organização não-governamental (ONG) União
Venezuelana.A legislação deverá abranger milhares de venezuelanos, que poderão
ter ATP durante um ano, renovável.Os beneficiários terão de ter entrado
legalmente no território peruano, "antes da entrada em vigor da disposição que
exclui a Venezuela do Mercosul", a 01 de dezembro de 2016.No entanto, também
alguns dos que entraram ilegalmente no Peru poderão ser abrangidos pelo novo
diploma "por razões de ordem humanitária".Entre os considerandos no texto do
decreto está o objetivo de "proteger e assegurar os direitos das pessoas de
nacionalidade venezuelana que se encontrem no Peru, em respeito irrestrito
pelos Direitos Humanos".Por outro lado, o decreto isenta os venezuelanos do

Comissão pede medidas de proteção para migrantes venezuelanos
A Comissão Interamericana de Direitos Humanos (CIDH), organismo dependente da
Organização dos Estados Americanos (OEA), pediu hoje aos países da região que
reforcem os "mecanismos de responsabilidade partilhada" para os migrantes
venezuelanos.

CIDH na sua página na Internet em que "expressa preocupação perante a
informação que indica que um grande número de venezuelanos se têm visto
forçados a emigrar para outros países de região, como mecanismo de
sobrevivência, como consequência da situação humanitária, em particular dos
efeitos que a escassez de alimentos, medicamentos e tratamentos médicos têm
gerado". PUB Segundo a CIDH, "perante a falta de canais legais, regulares
e seguros para emigrar, muitas pessoas não têm tido outra opção a não ser
recorrer a canais clandestinos que fornecem a migração irregular, através de
arriscadas rotas terrestres e marítimas", explica."A CIDH apela aos
Estados-membros da OEA para adotarem medidas para reforçar os mecanismos de
responsabilidade partilhada em relação à situação dos migrantes venezuelanos,
ao mesmo tempo que os insta a não adotarem medidas que limitem ou violem os
direitos humanos dos migrantes e dos que procuram refúgio, procedentes da
Venezuela", lê-se no mesmo comunicado.No documento a OEA "expressa preocupação
perante as atuações levadas a cabo a 09 de dezembro, no Brasil, com o objetivo
de deportar aproximadamente 450 pessoas, migrantes venezuelanos, em situação
migratória irregular, em Boa Vista (norte do Brasil), estado de Roraima, perto
da fronteira com a Venezuela"."As pessoas migrantes eram, na sua maioria,
indígenas da povoação indígena de Warao, entre as quais se encontravam homens e
mulheres, assim como mais de 180 meninos e meninas, incluindo recém nascidos",
detalha ainda o organismo.No comunicado a CIDH lembra que segundo "as normas
internacionais é obrigação dos Estados identificar, dentro das pessoas
migrantes, aquelas que tenham necessidades especiais de proteção", como
requrentes de asilo, refugiados, vítimas de tráfico, unidades familiares, entre
outros, e adotar medidas para a sua proteção"."A migração de pessoas de
nacionalidade venezuelana para Estados da região tem vindo a aumentar de forma
exponencial nos últimos anos. A CIDH observa com muita preocupação o aumento
exponencial dos requerentes de asilo provenientes da Venezuela", observa ainda
o organismo, indicando que em 2012 foram registados 505 casos, número que subiu
para 15.094 em 2015.No comunicado a CIDH manifestou também preocupação pela
decisão da Venezuela de encerrar as fronteiras com a Colômbia - o que sucedeu
várias vezes desde 2015 - e de ter feito o mesmo com o Brasil, ainda que de
forma temporária, em dezembro de 2016.
