Question for all: I am doing a brief in a case involving an ALJ's refusal to allow a claims examiner to testify in an overpayment case she investigated and issued determinations on because the claims examiner is supposed to be a neutral judge and judges don't testify. Does anyone have a case wherein your Court ever opined (or even in dicta) and laid out the functions of a claims examiner (investigations etc) such that I can trump this misguided interpretation of the ALJ.
