Joe. The U.S. Court of Appeals for the First Circuit has upheld a determination made by the Grant Officer and affirmed by an ALJ and the Administrative Review Board that Massachusetts is responsible for repaying DOL $9M in disallowed JTPA costs. The disallowance relates to a subrecipient not keeping proper records and not having audits done. We were wondering if any other state has had a final determination made against it for disallowed costs and what actions has DOL taken to collect the amount owed. I would appreciate it if this question could be posed on-line to the WIA Attorneys. Bob.
