I took a look at a random sample of the checklists on the TPWD
website. All I looked at have this statement "Please help protect
natural avian communities by refraining from using playback tapes of
bird songs. Frequent use of these tapes alters normal avian activity
patterns, disrupts essential territorial behavior, and may lead to
nest failure. Thank you for your cooperation." This isn't worded
strictly as a prohibition and I would suspect locally enforcement of
that varies from a request to stop to a citation. Also not all state
parks have checklists and not everyone gets them. I think because the
request is inside a publication that is normally charged for that TPWD
would likely rely on the migratory bird act for enforcement if it came
to that.
I think it's up to the birder community as a whole to educate new
comers to when its inappropriate to play recordings.
