Thanks Melissa for contacting the cemetery person.  Seems like he has had
some issues and has informed you that it is private.
 

So per ABA Birding ethics:

2. Respect the law, and the rights of others.

2(a) Do not enter private property without the owner's explicit permission.

2(b) Follow all laws, rules, and regulations governing use of roads and
public areas, both at home and abroad.

2(c) Practice common courtesy in contacts with other people. Your exemplary
behavior will generate goodwill with birders and non-birders alike.

Sure would be nice if they would put up a sign indicating that the cemetery
property was private so people would know.

But.  

A sign would like become a target.

And according to my theory based on observation about people and signs:

        Half the people don't read them and the other half don't think they
apply to them.

I may have the percentages off but you get the idea.

 

For what it's worth- ethics.
