Not strictly true.  If the keypad is locked, but Mute On Keylock is set to
No, which it is by default, you won't always get the tone.  But if you set
Mute On Keylock to Yes, then you are right, you should always get the tone.

This has never been an issue, provided that your key pad is locked you can
have the most complex melody you wish, Talks will only have issues where the
key pad is not locked.

Hmmm!  Yes, I know with some sound files, Talks need to be muted;  but,
strangely, I get my message alerts with my N95 and Talks on.  (My keypad is
probably almost always locked at the time they come in!)  I chose a short
sound which penetrates through the house so that I'm sure to pick it up and
it's (hopefully) not too much of a resource hog.
