Joe,

I'm not a dog owner, but, as Robert says,

Their rights are their rights case closed.

Just the fact!

I'm on their side.

Well , I know this according to the law I have read. But I will disagree
with you on which has access it is the service dog. You have the right to
access with or with out the dog. So the law is stating if you have a service animal the place of establishment is not allowed to charge a deposit for the
service animal. They would allow you to stay with out the animal. It's all
about the animal and the service they provide, Not about you as a person.
The only thing that matters about you in relation to the animal is do you
have a handicap or disability that requires this service animal. But here
again in my thoughts I think the place of establishment should be able to
charge a deposit just like our counter parts would have to pay. People with
out the handicap or disability. Just my thoughts.

Well, Joe; it isn't the dog that has the access right. It is the
individual, but no public place of accommodation can charge a deposit. They
can, however, charge for actual damages. I'm 55 and have been a dog guide
user for 35 of those years.

Well , just going by the emails, Not saying no one for sure does or does
not. Yes if you feel you have been done wrong you should take it to court
that is what the court system is for. I did not say you were not a good
dog
owner or handler, or any one else on this list. I too is a dog service
owner
and yes my dog sheds hair real bad. She is a Sheppard from Fidelco dogs. I love her to death and she goes to the beauty parlor at Petco at least once

a
month and sometimes more. I also have two other dogs that are not service
dogs. There is nothing you can hardly tell me about a domesticated animal
as
I have live on a farm all my life and I am 52 years of age. I have not
been
blind all my life a matter fact I have been blind only about 6 years and
legal blind about 10 years. So most of my life I have been a seeing
person.
Now my opinion on the Motel and Hotel business my self and this is just my
thoughts I don't see nothing wrong with making us do the same as our
counter
parts ( seeing people) do and put up a damage deposit . Yes in my opinion
I
think and we do should have the right to have our dogs with us most of the
time. Especially in a public place.

Dear Joe,

Can you tell me--and tell me how you know some of us don't respect our
fellow man?

You and I have never met; you know little about me, but I'm a damn good
dog
handler expects my dogs to adhere to a high code of behavior, and I get
it,
too, and she was just in the home of friends for the past couple of weeks
and she caused no damage whatsoever.

Robert's right: If I am unfairly assessed penalties, I'm going to
litigate
that case/ Dogs do not, as some believe, shed as much as people think,
etc.

It's apparent you have never had a guide dog and from the sound of it you
don't like dogs but I would think you have the ability to smell piss and
shit and hopefully you haven't lost all the feelings in your hands.
Guide

dog users should always be aware of what there dogs are doing and know
there bad habits. With an attitude like yours I certainly see why the
Florida Legislature has the attitudes they have about blind people.

Let me ask you how you know how much hair was left behind, what did your male dog pee on , what he or she or what ever the animal kind or type of
or
whatever chewed on. You don't because you can't see. I don't think I
taking
a right away you don't have this to start with. Yes the right to have
the
animal and to have it with you . But not to put up a deposit no that is
not
aright. Use common since people. This would be like taking your dog or
animal in a restaurant and going up to the buffet with him. I think this
is
not respecting other people and not having a animal with all that hair
and
his nose wondering about. Common since is not to do this. Ask the
waitress
to help you get your plate and take it back to the table. You all need
to
have respect for others. How are you going to get respect if you don't
give
it. I am a service dog owner also but I respect my fellow man and don't
want
to be treated special. I just want to be treated as normal as possible
witch
is hard to do given my handicap. This is just my thoughts and you are
welcome for me doing this. Smile! LOL!

Thanks for helping to take away our rights as service animal users, Joe;
maybe you can afford to pay for supercilious charges; send me your
address,
so I can send the bill to you while I'm filing a lawsuit abridging my
rights
to stay in a public accommodation with my service animal and not be
charged
for "extra cleaning" which should not need to be done unless the dog has
had
an accident.

Well, that might be the policy of that place. But different places will
have
different policies. I dis agree I don't think he has a case. They did
not
refuse him to let his dog stay They just charge a service charge for
the
dog
not because he was taking up a space but for more than likely the extra cleanup and inconvenient they had. This is my thoughts. Oh by the way I
have
a service dog also. I myself would not think anything about the extra
money
if they told me it will cost extra and the amount. Again my thoughts.

I use to work at the Marriott, and the polocy was exactly that. They
can't
charge you for your service animal, unless something happens. If they
are
doing this, you may have a case to make an issue. To me that is
extortion,
because this is tarting to happen in even cabs. In the miami aria, and
even
in some eating astablishments.

The late Bishop Joe Patterson told a story long ago, when i was a small child. About Elijah, and the 450 false prophets of bail. He said that Elijah, stood, and told the false prophets to go on ahead, because they
had
a much larger program. He said that they had 450 participants, and he
only
had one. Elijah, also reminded them, that they had to drag their god

Subject: [tabi] Question & answer about motel and service dogs

Thought some folks might find this interesting... although many may
already
know it : )

---------- Forwarded message ----------
Subject: Question & answer about motel and service dogs

A friend of mine who does training at Hilton Hotels tells me that it is
illegal to charge extra for a service dog staying in a hotel? I have
been
charged extra for my dog as we travel at motels by about 15 dollars a
room
for the dog. There is no problem with getting her in the room - but my
friend said that they can only charge if the dog does something in the
room
then that is fine. Their policy for pets staying in the room is $15 a
night
extra. This was new to me and I told her I could not recall reading
anything about this under title II.

Could you clarify this for me?
Thanks
.....

Answer:
Hotels are covered by title III, not title II. (Places of public
accommodation - title III vs. programs and services of state or local
governments (title II).

The issue you raise concerns an unlawful surcharge.

See http://www.ada.gov/qasrvc.htm , question 7:

7. Q: Can I charge a maintenance or cleaning fee for customers who
bring
service animals into my business?

A: No. Neither a deposit nor a surcharge may be imposed on an
individual
with a disability as a condition to allowing a service animal to
accompany
the individual with a disability, even if deposits are routinely
required
for pets. However, a public accommodation may charge its customers with
disabilities if a service animal causes damage so long as it is the
regular
practice of the entity to charge non-disabled customers for the same
types
of damages. For example, a hotel can charge a guest with a disability
for
the cost of repairing or cleaning furniture damaged by a service animal
if
it is the hotel's policy to charge when non-disabled guests cause such
damage.
