unbelievably, Allison just read me a story from a national magazine,
describing a 19 year old boy in Utah who got only 30 days in the county
jail, after admitting to killing 2 men in an "accident" caused by his
texting while trying to drive!

It seems that Florida isn't the only place where automotive deaths aren't
prosecuted as crimes. This did cause a change in Utah laws, and hopefully
we can send this story to some of our legislators and get them interested in
making similar legal changes.

Dear Erica,

But hit-and-run, even if the pedestrian at Joe Campbell Statidum is still a
felony here in Florida--or not?

Please, lets ALL remember that it is the Legislature (and, further back,
whom WE elect to comprise it) that determines what the laws of our state
are.

Because of my experience with a family member being seriously injured by a
careless (drunk) driver, I am VERY sympathetic to the outcry going up about
Meggs not pressing charges in the car crash earlier this year, believe me.
HOWEVER, AMAZINGLY, causing an accident when there is no alcohol or drug
impairment IS NOT a crime under Florida Statute!!! Is it unfair and
outrageous? YES. Is it a crime... not yet.
For those of us who are advocate-minded, here is yet another lead to follow
in making our streets safer.
This case also, of course, reiterates the ugly truth that every decision we
make-- like how to get into our car after a party-- can effect the rest of
our lives! Whether she was careless or not, that decision took about 2
seconds to make. ... Come to think of it, I'm sure the driver spent about as
much time assessing his/her situation before hitting said pedestrian.
Erica

Hi Charles,

no, you're right of course; didn't mean to sound like it was ok just

because she was in the street.

At first I did think she was being careless being in the street like

that, but since Erica gave us more info and said she was going to her

car, well, who knows then; we'll have to wait for a report from TPD.
