You make a good point about Red, Orange, Yellow, Pink, etc docs (and
yes, I
have personally had docs with each of those colors, not making it up!)
and
inappropriate use of NDA material.

On the other hand, there are publically available app notes,
downloadable to
anyone.  As long as you stick to the facts with your comments about
those....

documents. No matter how laughable it's, you talk about it in the open,

group of lawyers will come down on you.
Don't sign the NDA and don't look at it or keep your mouth shut.

Sued for libel?  Any manufacturer stupid enough to insult the technical
community by attempting that would be shooting themselves in the foot. 
Of course, there are some very stupid manufacturers out there (I've
known a
few).  I don't design in parts from any source whose business strategy
amounts to suing others.  On a completely unrelated note, no Rambus part
has
ever found its way into one of my designs.
