Scopes fall under IEC 61010-1 and IEC 61010-2-030, which call out creepage
and clearance distances for specific voltage levels.  A scope usually needs
to be rated to CAT II 300V due to its typical usage, but you have to read
the manual.  Here is a good but slightly dated overview...

Who decides what level of safety a scope probe has to meet?
