I had a co owner steal my dog AND sue for ownership. There was a written
agreement but dogs are personal property so no one really won. The dog
probably lost the most since she went from being a beloved pet and show dog
to being ignored in a kennel (unless there were puppies involved.) Funny
how this all happened after I paid to have her shown to her championship!

I agree with Anne and Even. Unfortunately in my contracts the terms were
clearly spelled out and all parties were happy and life was grand.


Then, without notice, one gal who I thought was my friend “surprised” me
with a lawsuit to take my dogs I never saw coming. That suit was settled
and I did get one of the dogs back.



After that situation apparently she solicited four other persons who
teamed up as “new friends”  who learned from her experience; breached their
contracts and sued me just like she did.



It is sad, especially when you trust the person(s) and they do that.



What frightens me is if they did it to me what other breeders will they do
that same thing to? My Grandmother used to say, “A Leopard does not change
his spots.” So if she sued me who is next?



If anyone wants a copy of the contract I used, which is actually very well
written and does cover just about every aspect you could imagine, I will be
happy to send it.

I'm sure you have heard the expression "fences make good neighbors".
Contracts can save a friendship if the terms are spelled out clearly to the
satisfaction of both parties.   If it is with a stranger, you better have
it notarized and all the legal stuff.

Maybe that doesn't work either - Evan?

Handshakes are fine but  - like I had no idea how much the co owner wanted
the dog to be shown - all at my expense.  In my case, it wasn't that bad
and we had a good relationship - I think.

But, a contract will outline what both parties expect.  I have seen a lot
of litigation when two people had different expectations.

Had a parolee who robbed a bank and the money in those days had red-dye in
packs that blew up while in possession of the bank robber! It caused the
dumbshits to wreck the get-away car! My guy ran and the other guy got hurt
and when apprehended was taken to the hospital, he gave my guy up.... When
Wearrested my guy and I told him his "pal" gave him up, my guy said
somethingto me that I will never forget.... He said " if you ever rob a
bank,rob it by yourself" words to live by, I currently co-own with BASU,
Evan, and Liz.... And although I prefer NOT to Co-own, you won't find
better
folks to co-own than that group. Ed

I understand your point with "possession," however, my point was if someone
signs a contract they should honor it, not sue you to steal your dogs. I
can't imagine how a life change could affect one's ability to keep their
wordor maintain a level of integrity.

The original question was about seeking a template of a "good" contract.
Frommy experience there are no "good" contracts. There are either people
who
are honorable or those who are not.

Seems many of the ones who are "not" used to call me.

That is where the old saying comes into affect...

"Possession is nine-tenths of the law is an expression meaning that
ownershipis easier to maintain if one has possession of something, or
difficult to enforce."

It is very sad when this becomes a issue but things do happen in people
livesthat change them and never know the what the outcome will be.

Sorry you had to go through this no excuse for it.

Greed will always be the reason people let you down.  I would never co-own
a GSD with another person.  Contracts have loop holes no matter how they
are written up.

Look. When I co-own, the person the dog is with,owns the dog,  has all
decisions, and just has my name in there.  I co-own Kierk with  Cappy, and
it
was to do with the National.  I like leaving her on him,it  gives me chops.

As for Ed, Teddy is all his dog, and I am not even sure  why  my name is
still on him. Maybe because I like being on a super all  black dog.  And,
he
is one great dog.
