If the GSDCA looses the law suit does it make it more likely that the
individuals would loose if Margy decided to sue them too?

There has been much discussion about the settlement that Marjorie has
proposed. What I have not seen is an offer for her to release the board
members in their individual capacities. As everyone will recall, I believe
that Marjorie initially sued each of the board members in their individual
capacities. Again, I believe that the case against the individual board
members was dismissed because the court lacked jurisdiction. However,
Marjory is not prohibited from bringing those cases again and in addition, I
believe that there have been many other allegations made about the conduct
of board members since the initial suit was commenced. If the board members
settle the case with Marjorie but are not released themselves, then it is
possible that Marjorie (who represents herself) could file another lawsuit
against them and then this lawsuit may not be covered by the GSDCA insurance
policy. Then what would the board members do? They would have to spend
their own money defending themselves.
I understand that some people have stated that this is the exact reason why
the board members have a conflict of interest and should therefore excuse
themselves from voting on settling with Marjorie. My response to that is if
the club does not support its board members from suits no one will ever
serve on the board.
In conclusion, no board member would ever agree to Marjorie's offer of
settlement unless they were personally released. This is very common. I
just don't know if Marjorie has made such an offer, but this could be what
is holding up the settlement.
