That is a key point that came up before. You have to go to Roberts Rules
of Order.
The board can't remove a board member elected by the membership. But,
they can suspend her privileges until the next general meeting. In this case
one of those would stop Helen from judging the National. It would also
preclude her from running for vice-president.
I don't think there is anyone who didn't know it was Helen who is being
charged with telling someone what was said about them in a closed session,
and also since Helen has requested the charges be in open session, there is
no secret.
When charges are brought, the board has the right to determine if they
want to hear them or not. This was a decision made by the board,and we have
no knowledge of who voted to do so.
How many remember when congress tried to remove Adam Clayton Powell from
the United States Congress? He thumbed his nose at them, since without a
full impeachment, someone elected can't be removed without the same voters
doing so.
I will be at the closed session, since the accused has a right to her
attorney being there. I can't give legal advice to the board or even to my
client. The club's attorney also is only licensed to practice in California.
I am only licensed to practice law in California, so if someone who
practices in New York, (where the club is incorporated), has another idea, I
would listen to them.
The California State Bar could sanction me if I practiced outside the
state.
