All of its owner criminal penalties for a dog that in any way injures a human, pet or feral cat have been removed. Thank you for your efforts to convince legislators that these provisions were too broad, unnecessary, inappropriate and would have created an enormous negative fiscal impact by crowding our courts and filling Virginia's jails. HB340 now focuses exclusively on creating a statewide dangerous dog registry for those animals judiciously determined to have injured any human, pet or feral cat. Tommy Wright's exemption for dogs injuring nonhumans while lawfully hunting remains in place. There's a potentially helpful, new, catch-all judicial standard for a court to decline to declare a dog dangerous, i.e. "for other good causes determined by the court." HB340, if vigorously enforced, could force a number of dogs to be put down. Its increased $300,000 liability coverage or surety bond necessary to keep a dangerous dog ensures that. I've documented 63 dogs determined dangerous in five counties in 2004; none of them have the required $100,000 coverage. That's certain to change very shortly, perhaps before this session's laws take effect July 1st. HB340's new dangerous dog spay-neuter requirement is a major negative state policy statement. No one has ever credibly linked sterilization to reducing an animal's aggressiveness. The spay-neuter provision in HB339 for impounded intact dogs and its deleted statewide $10/$5 fees reinforce the conclusion that this was a broad goal of Virginia's HSUS clones this session. Still and all, the amended HB340 is a much improved bill and, when combined with HB1039's felony provision for clearly irresponsible owner behavior and a serious human injury, it should allow General Assembly legislators to advance the House's dangerous dog effort over any bill passed by the Senate.
