TX RPOA E-News March 21, 2006 Update on the threat of Breed Specific Legislation in Texas Many of you responded to our request for letters to the editor after the San Antonio Express-News published an article revealing Breed Specific Legislation (BSL) would be filed by Senator Jeff Wentworth at the next session of the Texas Legislature. The regular session convenes in January 2007. The newspaper was kind enough to print a large number of our letters, including RPOA's letter. Shortly thereafter RPOA met with Senator Wentworth in his San Antonio office, which is only a block away from our office on Loop 410. Senator Wentworth was most gracious and said the newspaper misunderstood him. He says he has no intention of filing BSL. We told him that we would like to see legislation drafted that we could support. We mentioned our affiliation as an American Kennel Club (AKC) state federation and told him AKC opposes BSL. It was a very productive meeting. RPOA member and Houston attorney Jeff Shaver (Rottweiler enthusiast) will be working with the senator's attorney to draft legislation that will strengthen the existing Texas Dangerous Dog Law. Jeff saved us during the last legislative session when the attempt was made to allow Houston to be exempt from existing state law prohibiting BSL. We defeated it with a lot of help from our friends. A fatal attack in Texas by six mixed breed dogs (supposedly pit bull/Rottweiler mixes) on Lillian Stiles in her own front yard set off a cry for amending the Texas Dangerous Dog Law. Two of Lillian Stiles' daughters met with Senator Wentworth and received his commitment to draft a bill. Despite claims that the Texas state law is weak, Jose Hernandez, the owner of the dogs, has been charged with Criminally Negligent Homicide. Texas Families Against Dangerous Dogs has been formed by Lillian Stiles' daughters. RPOA has contacted them, expressed our deepest sympathy to the family and told them we too are opposed to dangerous dogs. The daughter we spoke with does not want BSL and said she had been looking for a group like ours to help her. We will certainly support her efforts if good legislation is drafted. We'll probably be facing more than one bill filed at the next Legislative Session attempting to rescind our provision in state law prohibiting BSL. The Texas Municipal League adopted a resolution at their Annual Meeting last October wanting it rescinded just as they did before the last legislative session. However if we get a bill we can support, our position will be strengthened. We are fortunate to have Senator Jeff Wentworth leading this effort. We'll keep you informed.
