The agenda confirms the Public Hearing on November 30, 9:35 a.m. (1010-10th Street, Modesto, California) to consider the proposed ordinance reported in our October 1 publication. The proposed ordinance combine the City of Los Angeles formula of $100 unaltered license PLUS $100 breeding permit for BOTH dogs AND cats , with some San Mateo County provisions and adding cats to the leash law. The rationale is to contain "overpopulation" in Stanislaus County including "mass euthanasia" and escalating costs. The 11/30 staff report includes new fiscal details including a request to authorize and fund 3 additional positions to enforce the ordinance, purchase software for online license sales and provide s/n vouchers to County residents. It states that the Animal Services Department "projects the total one-time cost to be $69,500 and the on-going annual cost to be $118,564. The animal estimated increase of revenue is projected to be $360,000. This figure is based upon the success of the Los Angeles Ordinance which has achieved a spay and neuter compliance rate of 75%. Using current license information, 5,000 dog owners would pay the higher license fee of $100, a $72 increase per dog per year. This estimated increase in revenue does not take into consideration the licensing of cats. Currently there is no available information on how many pet owners would be affected by the new license requirement for cats. All of the generated revenue, less administrative costs would be used for the spay and neuter program for cats and dogs." The Department of Animal Service's rationale is seriously flawed and based on multiple faulty presumptions. Because licensing compliance is universally low throughout the United States, regardless of fee levels, a high or increasing percentage of altered license sales may only indicate that higher fees are a disincentive to licensing unaltered animals rather than a measure of the percentage of altered animals in the community. And when the ratio of altered licenses increases, revenue from licensing remains flat or actually declines. Most cat licenses are issued in connection with shelter placements, and the now widely recognized adverse feline health issues associated with rabies vaccination give pause to re-vaccinating (and thus, re-licensing) cats at low risk for exposure. The Department again asks for this ordinance because of the high number of euthanasias in its shelters. Meanwhile, the Hayden bill (shelter requirements) enforcement litigation movement, reported in our November 9 publication, is considering Stanislaus County as its next target according to an article in today's Modesto Bee <http://www.modbee.com> The first Hayden lawsuit is in Kern County where in past years we detailed the long history of Kern County task forces that revised the animal ordinance. The 2002 ordinance revisions increased unaltered dog license to $60. The current Stanislaus County ordinance proposal includes: * $100 annual license for intact dog or cat over 4 months, $12 for altered, ½ over 65 yrs. The current unaltered dog license is $28 and cats are not licensed. * $25 late fee after 30 days and nonpayment within 15 days is an additional infraction. * exempts registered barn or feral cat colonies by provisions verbatim from the 1995 amendments to the San Mateo County Pet Overpopulation Ordinance; government agencies, California incorporated humane societies, and approved rescue organizations. * adds cats to the Animal Restraint law so as to include cats in the leash law * mandatory microchipping of intact dogs or cats over 4 months that are "unsupervised in a public place" or the subject of a breeding permit *Breeding only with $100 annual breeding permit for cat or dog, subject to regulations by Director of Animal Services; no more than one litter per animal in any household within the permit year with a one-time exception for health reasons (based on the City of Los Angeles language from the 1977 breeding permit; no transfer prior to 7 weeks and first "immunization against common diseases;" signed seller statement of health and immunization history; permit number in ads, on sale documents and businesses selling locally bred animals; provide written permit and licensing information to transferees. A typical list of exemptions was taken from similar ordinances and does include veterinary contraindication for sterilization. * Violations may be corrected by correction and/or proof of sterilization within 30 days, and if not, a $500 penalty, again based on City of Los Angeles 2000 amendments. If the penalty is not paid and/or corrections done within 15 days, and additional infraction applies. Penalties for other violations are increased. * The breeding permit is subject to revocation for violation of any state or County animal law, nonpayment of fees, refusal to allow inspection of the animal/premises on 48 hrs written notice or disposition of the animal. * Assorted common provisions relating to transfers.
