CALIFORNIA AB 1428 by Assembly member Assembly Member Lloyd Levine (D-40)
of Van Nuys to prohibit the retail sale or transfer of a cloned or
genetically modified pet animal (not just cats and dogs) within California
failed in the Assembly Committee on Business and professions on May 3 but
was granted the routine courtesy "reconsideration" for a theoretically
possible second vote in January.  The bill would have required 6
affirmative votes from the Committee of 10 (7 Democrats and 3 Republicans)
but received only 2 aye votes - from Assembly members Paul Koretz (D-42) of
West Hollywood and newcomer Karen Bass (D-47) of Los Angeles.  The
Committee consensus was that legislation in this emerging field is
premature and unwarranted on the basis of the proponents' arguments at this
time.

CALIFORNIA AB 418 by Assembly Member Paul Koretz (D-42) of West Hollywood
to prohibit dog ear cropping in California, in the Assembly Committee in
Appropriations Suspense File since April 13 is now on the very long list of
Suspense bills set for vote to be removed from Suspense (no testimony) at
the May 25 Committee meeting, 9:00 a.m., State Capitol, Room 4202.

AB 418 was placed on suspense at the April 13 hearing due to issues raised
by The American Kennel Club about the potential for sufficient negative
impact on California sales tax from decreased purchases made by persons
attending California dog shows should the bill be enacted.  At the hearing,
author Koretz claimed that AKC dog shows were "cash cows" for AKC and that
more dogs would be shown in California if the bill were enacted.  In fact,
AKC receives only minimal fees from shows to cover its associated costs.
Show-giving clubs are local, volunteer nonprofits that do not always make a
profit from which proceeds are divided among reserves for the next show,
ongoing expenses including community outreach and often support for an
array of other organizations in the community.  A number of small
businesses derive much or all of their revenues from vending merchandise or
services at shows and generate state sales tax in addition to other
expenditures by show entrants.  Conformation showing in California has
never been attractive for out of state residents, and overall reduced
entries would never be offset.

If the bill should pass out of Appropriations, the policy issues will again
be paramount.  The question is whether ear cropping is a safe, humane and
reasonable procedure; it must not be classified as animal cruelty.  We must
argue that this is a specialty procedure, safe and humane with minimal risk
when performed by a skilled practitioner and done for rational purpose.
Dogs undergo anesthesia for many medically unnecessary procedures such as
sterilization, dental cleaning and x-rays and are discharged home the same
day.  This risk is minimized by familiarity with  breeds and expertise.
Recovery is rapid.  Cropping protects individual dogs from the risk of
normal trauma from work and play having nothing to do with illegal
dog-fighting which is deterred by other laws.

Author Koretz and supporters claim that cropping is archaic, cruel,
inhumane, senseless and disfiguring and should be a misdemeanor crime.
Since the penalty does not include incarceration and prosecution costs are
supposed to be offset to some degree by the fine of up to $10,000, the
enforcement cost to government is much less than typical misdemeanors.
However, the cost and detriment to violators would be substantial and costs
of enforcement are undetermined.
