There is a real dispute between what the membership wants, and what the
board has decided. It is not all of the board, but it is safe to say that
those named in the lawsuit have taken a position of self interest and want to
push this matter to trial. They have failed to consider the best interest of
the club and the members.
I, as a trial attorney, often settle a case, in the best interest of my
clients. I have settled cases that I knew I would win, because the risk or
even just the pressure on my clients were not worth what they had to go
through. I love to litigate. I am never happier than when I am in court. But,
the
client should come first.
I would urge the new board to insist that those members with a personal
interest in the law suit recuse themselves, and the remaining members do the
right thing for the GSDCA and the members. Also, we are not so fragile
that it has to be done in a closed session. If they don't want us to know what
they say, then don't say it.
This is much harder for me to accept as an attorney who litigates every
day, than for anyone who does not know the process to stomach. But, I love
this sport, support my club, stand behind our board, and just wish they would
listen to their legal advisor.
