What Flower Boy is referring to is when he saw me argue before the
California Supreme Court.
It doesn't get more fun than that. The Justices think they have some
advantage being appointed to the position by the governor. I never saw it
that way. So, when I am in front of a judge, I just say my mind. Often they
don't agree with me, but on the other hand, often I don't agree with them.
I just got a decision on an appeal I filed in the Court of Appeals on a
decision in Probate Count, yesterday. I overturned a judge who was wrong.
Judges do make mistakes.
At a dog show, you don't get to appeal the decision.
Not that there is anything wrong with that.

The last case I had like this was a terrible case I took to trial. I
always felt my client was in the wrong place, but the government was equally
wrong.
My client owned two shepherds. The neighbors had gone on vacation and
left the sliding door open so their small dogs could get out, and their
daughter came be each day to feed them.
The shepherds got out, went under the fence, into the house and killed the
dogs, then went home and went to sleep.
The county wanted to kill the shepherds and the client hired me to take
the case to trial.
I did so, and proved that the small dogs had for months been provoking the
shepherds. I brought in an expert, Bob Penny, who testified as the
temperament of the German shepherds and how they were agitated by the other
dogs
running back and forth at the fence taunting the shepherds.
The ordinance only allowed putting dogs to sleep that had harmed a person,
or killed another dog, unless agitated by the other dog.
We won, and my client was ordered to carry insurance for his dogs, put up
a stronger fence, and to always have his dogs fenced in while he was not
home.
Sometimes the only solution to this sort of government action is to take
the case to trial. Most of the people on the jury will side with the dog
owner.
In this case I stipulated to have it heard by a judge. I guessed
correctly. Although at the end of the trial the judge said he didn't know what
else
he could do but put the shepherds down. I told him he was elected to
follow the law, and that was his only choice.
I don't think he much liked me lecturing him on the law, but it was
necessary, and worked. Judges can be just as wrong as the rest of us.

In my 35 yrs fighting the AROS this is surely in my Top 10 when it comes
to how unjust it is. They've tracked many of the key players back to HSUS
and the ARO's. Sad as it is there seems to be no end in sight. The trial will
be the true indicator. I pray they find justice.
