I would not accept the note, nor would I read it. First of all, it is
hearsay, a statement made by someone not available for cross-examination.
Second,
there is no way to know who wrote it, and with computers it is very easy to
prepare a piece of stationary. Not that any German shepherd person would even
consider such a thing. Maybe in other breeds.
It would depend on the fault, as to what I would do about it. If it were
something such as a White Dog, I would penalize it as required in our standard,
even if caused by extreme fear in an isolated event causing the dog to turn
white. If it were a fault such a biting the judge, I would have to use the
full penalty even if there were a note that the dog was aggressive due to poor
prior treatment.
As an attorney I am more sensitive to documents, and suspicious as to their
validity.
Not that there is anything wrong with those letters.
