CROSSPOSTED It appears (by my understanding) that HB 189 has been replaced by HB 533 which is greatly watered down and even though removes pit bull dogs as prima fascia evidence of a vicious dog it specifically allows local communities to make "more restrictive legislation". This goes to Committee on March 22, 2006 and the bill as an end result does NOTHING for the responsible dog owner. It simply puts the responsibility of enforcement on the local jurisdictions. Sec. 955.221. (A) For the purposes of this section, ordinances or resolutions to control dogs include, but are not limited to, ordinances or resolutions concerned with the ownership, keeping, or harboring of dogs, the restraint of dogs, dogs as public nuisances, and dogs as a threat to public health, safety, and welfare, except that such ordinances or resolutions as permitted in division (B) of this section shall not prohibit the use of any dog which that is lawfully engaged in hunting or training for the purpose of hunting while accompanied by a licensed hunter. However, such dogs at all other times and in all other respects shall be subject to the ordinance or resolution permitted by this section, unless actually in the field and engaged in hunting or in legitimate training for such that purpose. Ordinances or resolutions to control dogs that are adopted pursuant to this section may define "dangerous dog" or "vicious dog" more broadly than those terms are defined in section 955.11 of the Revised Code, and such expanded definitions shall not be considered to be in conflict with the Revised Code.
