Language in these bills will lead to unintended consequences!
New Jersey legislators have approved A 3205 and S 1643, which were  
drafted to address certain details in the work of animal control  
officers and the impounding of stray animals.

While the legislative staffers working with animal organizations have  
been helpful, areas of serious concern remain. For instance, while the  
bill makes clear that only certified animal control officers may  
impound strays and may only use licensed shelters, pounds or kennels  
that serve that purpose, the definition of animal rescue organizations  
indicates that these organizations are also empowered to impound strays.

Also, the provisions in the bill that authorize animal control  
officers to seize animals that are off their property could be  
interpreted to include dogs that are involved in performance  
activities or working activities off their property. Dogs that are  
engaged in hunting, training, showing and other canine sports and  
events while under the control of their owners often do not wear tags  
because of their potential to become entangled or otherwise interfere  
with their performance or judging.

Dogs that participate in American Kennel Club conformation events  
(breed judging) must be intact. This bill as presently written would  
authorize an animal control officer to seize such animals.

The section on microchipping is positive, but should also require that  
all officially recognized sheltering and rescuing entities have the  
technology necessary to scan for microchips and thus identify the  
animal's owner.

Establishing a registry of animal rescue organizations is important  
and all such organizations should be required to participate in the  
registry. This is a critical public health issue. If a contagious  
canine or feline disease is introduced into New Jersey, the Department  
of Health needs to be able to contact everyone who has been in contact  
with the animal as quickly as possible to avoid the spread of the  
disease.
