AB 241 Lurches Forward  
Take Action!

Urge your Assembly Member to NOT concur!

Earlier today, the California State Senate passed AB 241 on a vote of  
23 ayes to 8 nays. Senator Dean Florez presented the bill, followed by  
no debate or discussion before the vote was called. That is truly  
remarkable given the significant economic and fiscal impact AB 241  
will have on the state of California and law-abiding dog and cat  
breeders who will be profiled based on numbers alone.

We believe the best way to improve conditions for breedeing cats and  
dogs is to ensure that facilities are properly regulated.  
Unfortunately this bill could actually worsen conditions for animals  
by pushing substandard operations underground where they will receive  
no oversight while eliminating experienced breeders, some of whom have  
been licensed in the state of California for decades.

Because the bill was amended in the Senate, it must return to the  
Assembly, its chamber of origin, for concurrence on the amendments  
before it can advance to the Governor?s desk. Please write your  
Assembly Member today respectfully asking them to NOT CONCUR on the  
Senate version of AB 241.

While we have been opposed to this HSUS-backed legislation from the  
beginning, it was amended four times in the Senate, and there are  
plenty of new reasons to oppose it:
The most notable amendments, (adopted on June 23rd), stipulate that,  
while the statewide cap is set at 50 adult dogs/cats, local  
governments are free to impose harsher limits of their own. This gives  
cities and counties carte blanche to lower the limit to 25, 10 or any  
number they subjectively deem to be a "puppy mill".
The August 24th amendments define an adult dog/cat as 4 months of age,  
which has the potential to allow unsold puppies to be counted toward  
the total number permitted under this bill.
The August 24th amendments also contain a provision that would  
implicate anyone connected to a breeder in violation of the cap by  
making it a misdemeanor to aid, abet, counsel, command, induce,  
solicit, request or assist that person or business. This could  
arguably impact handlers, trainers and perhaps even co-owners.
We must emphasize that at no point were the full costs of AB 241 ever  
formally taken into consideration or reviewed by the appropriations  
committee in either chamber. New concerns about the fiscal impact of  
AB 241 were raised by NAIA as well as the Department of Finance, but  
ignored by the Senate Committee on Appropriations, who sent the bill  
straight to the floor without a hearing.

The California Department of Finance issued an analysis opposing AB  
241acknowledging the facts and estimates gathered by NAIA and other  
groups representing responsible pet owners.

points below, strongly urging them to oppose this slippery slope  
legislation.
