Rural Missouri voters flooded the polls in an effort to defeat a ballot initiative that will put dog breeders out of business. Indeed, for most of election night, returns suggested opponents of Proposition B might succeed. Ultimately, however, disproportionate support from heavily populated areas such as Jefferson and St. Louis resulted in passage of the initiative in a very close vote. A coalition of pet- friendly breeders and organizations worked feverishly to educate voters as to the true impact of the proposal, but advocates promoting Proposition B were backed by big funding, and had time on their side. The pet industry’s success in battling this ballot initiative right down to the wire, however, demonstrates that such proposals can be defeated and must be defeated where they appear elsewhere if Americans are going to continue to have the right to responsibly buy and own pets of their choice. The Impact. With passage of Proposition B, the so-called "Puppy Mill Cruelty Prevention Act” becomes law, and its provisions will become effective in a year. The new law creates the crime of “puppy mill cruelty.” Those in violation of any the act’s standards will be guilty of a Class C or Class A misdemeanor. Among the law’s provisions is a ban against having custody of more than fifty intact dogs over the age of six months for the purpose of breeding them to produce pets. Other requirements of the act include: • Prompt treatment of “any illness or injury” by a licensed veterinarian. While current law already requires appropriate veterinary care, Proposition B would mandate a veterinarian see every dog for any condition, no matter how minor. This would be akin to requiring that children be taken to the doctor every time they stub a toe or suffer a scratch! • Temperature ranges that never fall below 45 degrees Fahrenheit, or rise above 85 degrees Fahrenheit. This requirement is inappropriately restrictive and is inconsistent with health requirements of all dogs. It is a one-size-fits-all standard that ignores the varying health requirements for different breeds and acclimations of dogs and is wholly unsupported by science or veterinary medicine. • At least 12 square feet of indoor floor space per each dog up to 25 inches long, at least 20 square feet of indoor floor space per each dog between 25 and 35 inches long, and at least 30 square feet of indoor floor space per each dog for dogs 35 inches and longer. These requirements exceed federal law and are not supported by any valid scientific study. They are purely arbitrary standards. Anybody having custody or ownership of more than ten female covered dogs for the purpose of breeding them, and selling any of the offspring for use as a pet, is subject to these provisions. Those who meet this threshold should be familiar with all provisions of this act. The Result. Barring judicial action that delays implementation or invalidates specific provisions of the "Puppy Mill Cruelty Prevention Act,” persons subject to the act will be required to comply with its requirements starting next year.
