Breeder Permitting, Mandatory Spay/Neuter Proposal in Dallas, Texas

The Dallas, Texas City Council will soon consider major changes to the Dalla=
s=20
animal control ordinance. The changes include breeder permitting, limits on=20=
t
he number of pets that can be owned, stricter dangerous dog language, and a=20
ban on tethering.=C2=A0

Breeder Permitting

     =E2=80=A2     This proposed ordinance mandates that you spay or neuter=20=
your dog=20
unless you obtain a breeder permit for each intact dog.
     =E2=80=A2     Breeder permits will only be issued to owners of dogs of=20
"recognized" breeds.
     =E2=80=A2     The permit will cost $500 per year and will restrict bree=
ding to=20
one litter per permit per year. Further, breeders are prohibited from sellin=
g=20
puppies until they reach eight (8) weeks of age and have been immunized.
     =E2=80=A2     In order to redeem a dog from impoundment, it must be spa=
yed or=20
neutered or the owner must purchase a breeder permit for that animal.


Breeder licensing fees place an undue burden on responsible breeders and=20
owners and fail to address irresponsible individuals who neither comply with=
=20
existing law nor will comply with new regulations. Such fees therefore punis=
h=20
responsible breeders who give the care and attention that puppies need in or=
der to=20
grow into healthy, well-adjusted companions and neighbors. Responsible local=
=20
breeders also provide a support system to new owners; assisting them with=20
housebreaking, training questions, behavior issues and basic new puppy care=20
inquiries. Further, mandatory spay/neuter is an ineffective solution to anim=
al=20
control problems because it fails to address the heart of the issue=E2=80=
=94irresponsible=20
ownership. Mandatory spay/neuter laws are extremely difficult to enforce and=
 can=20
be evaded by irresponsible animal owners by not licensing their pets. More=20
regulations increase the workload of already financially strained animal con=
trol=20
offices, making it even more difficult for them to perform their duties.=C2=
=A0

Pet Limit

     =E2=80=A2     The proposal also creates a limit of six dogs or cats or=20
combination of both per dwelling.
     =E2=80=A2     There will be a grandfather clause for current owners who=
 list all=20
their current animals with the Director of Animal Services and are in=20
compliance with all other regulations.
     =E2=80=A2     There will also be an exemption to foster care providers=20=
who have=20
been approved by the Director of Animal Services.


Not only are limit laws easily evaded and difficult to enforce, they fail to=
=20
address the heart of animal control problems--irresponsible ownership.=20
Effective implementation of existing leash and curbing laws, rather than pas=
sage of=20
new burdensome regulation, would prevent pet owners from allowing their anim=
als=20
to run loose, while clean-up ordinances would require owners to take=20
responsibility for their pets.

Dangerous Dogs, Tethering and Confinement Requirements

     =E2=80=A2     The draft ordinance requires all dogs deemed dangerous to=
 be=20
spayed or neutered.
     =E2=80=A2     The owner of a dangerous dog must obtain liability insura=
nce of=20
$100,000.
     =E2=80=A2     Any dog that has been determined to be dangerous by anoth=
er=20
jurisdiction will not be allowed into the city.
     =E2=80=A2     Any tether used must be at least 10 feet long and be atta=
ched to=20
the dog's collar or harness and not the dog itself.
     =E2=80=A2     The area in which dogs are kept must be at least 150 squa=
re feet=20
per dog, if the dog(s) lives primarily outside.


The AKC believes the answer to population issues is strict enforcement of=20
leash and nuisance laws, rather than passage of new burdensome regulation. T=
he=20
key to resolving this issue is to implement and expand the wide range of=20
programs available to educate the public about responsible breeding and anim=
al=20
ownership practices.=C2=A0
