BRIEFLY NOTED

CA AB 1634 (LEVINE/NAVA/PADILLA/SOLARIO) the "California Healthy Pets
Act" remains in the Senate Local Government Committee following its
July 11 hearing when testimony but not vote was taken. Proponents
are posturing for another run this year with a revamped website, new
buzzwords like "common sense", "humane" and "taxpayer friendly",
slippery "rebuttals" based on more distortions, a new graphic and
message in its daily Roundup advertisement and immediate publicity
from its proponents local efforts in the City of Los Angeles and in
Huntington Beach.

CITY OF LOS ANGELES, nearing the deadline for action on its May 2007
motion to draft a mandatory sterilization provision for dogs and cats
at 4 months, squeezed in a first reading on February 1 before the 15
member City County and passage (10-1, 4 absent) and afforded AB 1634
proponents a new round of media coverage. The City exemptions to the
mandate are for approved DOG or CAT registry event competitors,
approved DOG registry or association title holders or those under 3
years working toward titles, certain service and guide dogs, dogs
being trained or actively used by law enforcement, military
or "rescue activities", a restrictive veterinary exemption, or dogs
or cats covered by a breeding permit ($100 per year but no registry
or competition requirement). Additionally, unaltered dogs or cats
must be micro-chipped. Unaltered dog licensees will escape
enforcement until July 1, 2009. There is no cat licensing to serve
as an enforcement point. Penalties include mandatory sterilization
in addition to civil fines and community service, stepped up until
the third violation MAY bump up to a misdemeanor. Also created is a
15 member advisory committee to advise the Commission on the impact
of spay/neuter services on low income residents. Second reading
passage is expected. Also in the pipeline in the City of LA has been
a proposal for a transfer permit parallel to the breeding permit but
possibly covering ALL animals.

HUNTINGTON BEACH ("SURF CITY USA"), ORANGE COUNTY, CALIFORNIA City
Council
Monday, February 4 agenda returns a disingenuously revised but
substantively unchanged mandatory spay/neuter and microchip ordinance
for BOTH dogs and cats at 6 months based sketchily on the Los Angeles
County model exemptions, including a club membership option. LA
County includes only dogs in its MSN ordinance, but Huntington Beach
would add a new cat licensing requirement as a point of enforcement.
The HB proposal would also require a city business license in order
to advertise any dog or cat available for any type of transfer
regardless of whether the owner is in business. City business
licenses begin at $75, plus a processing fee and a one-time $2.00
Home Occupation Permit. This requirement would encourage surrender
or even abandonment by owners unable or unwilling to obtain a
business license for as little as a single transfer of personal
property. Also on this agenda is a resolution setting fees for the
new ordinance. The Council may either accept or deny these items.

CALIFORNIA BILLS introduced in 2007 had to clear their house of
origin by January 31 in order to remain in progress. Last month, we
tracked four active bills, three of which were "gut and amended" from
unrelated bills and passed and the fourth original bill was finally
dropped. These are:

CA SB 685 authored by Leland Yee (D-8) of San Francisco would amend
sections of the California Probate Code covering pet trusts and ia
sponsored by the San Francisco SPCA and some humane groups. Due to
the complexity of trust law, the Senate Judiciary Committee policy
analysis cited a number of issues to be addressed by amendment, and
SB 685 has passed the committee and Senate Floor without opposition.

CA SB 902 authored by Alex Padilla (D-20), former Los Angeles City
Council member and Senate co-author of AB 1634, is a new version of
last year's SB 828, requiring the State Fire Marshall to update
regulations for accelerant canines and their handlers. Governor
Schwarzenegger vetoed SB 828 as unnecessary. SB 902 was amended to
extend the update deadline to 2011 and passed 34-4 on the Senate
Floor.

CA SB 986 authored by Mark Ridley-Thomas (D-26), also a former Los
Angeles City Council member, is a correction to last year's AB 1347
to amend the definition of "pet store" to exclude the selling or
offering for sale animals for purposes directly related to an
agricultural operation for the commercial growing and harvesting of
crops or the raising of livestock or poultry on a farm or a ranch.
Sponsored by the Pet Industry Joint Advisory Council (PIJAC), SB 986
addresses the request of the California Department of Food and
Agriculture (CDFA) to ensure that agricultural establishments are not
considered pet stores for purposes of the California Pet Store Animal
Care Act (2007 AB 1347, Caballero) that will go into effect January
1, 2009.
SB 986 passed on the Senate Floor 34-1, Sheila Kuehl voting no.

CA AB 667 authored by Cameron Smyth (R-38) of Granada Hills would
have amended the Penal Code to increase penalties for maliciously
injuring a dog or horse used by a peace officer. The first hearing
in the Public Safety committee had been cancelled by the author last
year and the second last month, effectively ending this bill although
it had been amended to reduce the penalty levels from those in the
original bill. The legislature has been reluctance to increase
penalties for existing crimes and carefully scrutinizes penalties for
new ones due to the many associated costs and currently over-crowded,
deficient and dangerous jails and prisons.

NEW CALIFORNIA BILLS must be introduced by Friday, February 22, and
we will be listing, tracking and reporting developments as warranted
either on the web site or through these Updates.
