The mandatory microchip requirement in the recently passed San Marcos, 
TX ordinance may be rescinded !!
 
We can thank Dr. Katherine Albrecht for her work to oppose and organize the pet 
owners' rally in early March.  Dr. Albrecht's excellent letter is below in 
which she refers to the Riverside County dog who recently bled to death when 
microchipped, as required by the new ordinance. 
 
Hopefully when the advisory committee gets going in Riverside 
County, San Marcos, TX will be used as an example and reconsideration of the 
mandated microchipping in this county will be urged.  Dr. Albrecht's research

This shows what happens when pet owners stand up united to oppose anti-pet 
legislation.  Microchipping pets should be a decision made by the pet owner 
in consultation with their veterinarian and NOT a government mandate.  RPOA 
sent a letter of opposition with accompanying documentation from Dr. 
Albrecht to all San Marcos elected officials before this was passed in 
ordinance.  But they do not listen without hundreds of warm bodies in their 
chambers to protest.  Congratulations to the group in San Marcos working so 
hard to get the mandatory microchip provision rescinded as this helps all of 
us!  We support their efforts.
San Antonio never had the mandatory microchip written in ordinance as has 
been reported in the media.  It was mandated by the former animal control 
director without council approval. San Antonio's Interim Director Vincent 
Medley has announced the microchip is no longer required to purchase the pet 
license in San Antonio but the city's website hasn't been changed yet.  The 
change was due to the fact few pet owners bought the pet licenses.

As you know our protest last week was a huge success!  THREE HUNDRED PEOPLE 
(emphasis RPOA's!) turned out for our protest and candle light vigil outside 
the San Marcos City Hall.  Your overwhelming numbers and obvious commitment to 
liberty were heard loud and clear.

The City Council agreed to revisit the mandatory microchipping provision and
sent the ordinance back to the Animal Services Advisory Board to be
discussed and rewritten.  San Marcos Mayor Susan Narvaiz has now taken a
position that all pet microchipping should be voluntary.  She shared this
position with me in a meeting and also on camera with members of the local
media.  I am pleased to see our message has had such a positive impact on
city officials.

Thanks to every one of you who turned out, testified, and took the time to
stand up for animals and personal rights.  I anticipate that this will be
just the first of many similar protests around the country.  Freedom loving
Americans have begun to say no to the microchipping agenda.  Thank you for
being the spark that has ignited this movement.  We have collected dozens of
news reports and will be sharing these with you shortly.

Dear Mayor Narvaiz:

I am writing to urge the City of San Marcos to reconsider its mandatory pet 
microchipping ordinance. As you may know, a dog died just last month after 
receiving an RFID microchip implant, thus raising new questions about the 
safety of the chipping procedure. This tragic incident is part of a growing 
body of evidence that has caused many communities to reject mandatory 
microchipping in favor of voluntary programs that leave the choice of 
microchipping up to the pet owner.

According to documentation from the FDA, the British Small Animal Veterinary 
Association, and a number of respected veterinary and pathology researchers, 
the risks associated with microchip implantation are numerous. They include 
paralysis or death from improper insertion, MRI incompatibility, migration of 
the implanted transponder, transponder failure, electrical hazards, tumor 
formation, infection, abscess, cancer -- and now, death from bleeding.

I have enclosed documentation that provides evidence of each of these risks, 
including a review of multiple research studies showing that microchips have 
caused cancer in laboratory rodents and in dogs. I have also enclosed an 
extensive "Frequently Asked Questions" document that may help address any 
questions you or your colleagues may have on this topic.

My research in this area has been extensive. As a Harvard-trained researcher 
and privacy advocate, I have spent over six years educating policy makers and 
the public about risks associated with RFID technologies. I have delivered 
invited testimony before the Federal Trade Commission, various state 
legislatures, the European Commission, and the Privacy Commissioner of Canada. 
I was appointed by Governor John Lynch to serve as an expert member of New 
Hampshire's two-year RFID study commission, and my work on RFID has been 
published in respected journals such as Scientific American, the Denver Law 
Review, and the American Legislative Exchange Council's "ALEC" journal.

I applaud your efforts to promote the safety and well-being of animals in San 
Marcos. With that end in mind, I strongly urge you to modify the Animal Control 
Ordinance to allow pet owners to decide this important issue for themselves, in 
consultation with their veterinarians. 

I will be attending the San Marcos City Council meeting on Tuesday, March 3rd, 
and will be happy to provide testimony or answer any questions you may have at
