It is unfortunate that we live in a society where the threat of lawsuit
brings
people to their knees whither or not there is justification.

You say that as if it is a bad thing. We lawyers dwell on this all the
time. But, no one should be afraid of litigation, if they are right.

In this case, as directors they are protected big time, and not only by
insurance, but as those who follow the by-laws of the club. When I was on the
board, I shouted this out often, when some tried to scare others into voting
one
way or the other.

1. That in setting a pattern of not denying membership to anyone and by
assuming that we cannot do so, we may give up our right to do so for good
and valid purposes.

This is a problem, as this board, at the prior meeting denied membership to
an applicant. The board has the right, and perhaps the obligation to do
this. Evidently this time it was claimed they could not deny membership, and
that
is wrong. I know of three instances when membership was denied, and it was
not the reason to vote either way, on the Hunte issue.

It is my hope that the board can discuss not only the decision it
made, but also the assumptions that the list seems to imply are present. We
need a solid and secure atmosphere in which our board members are not
intimidated, are not in fear of personal loss and are not overwhelmed.

We have adequate insurance, (thank to Dan Smith for posting so), we have
protection from liability by being a non-profit private club, having
incorporated, and working within by-laws. None of this should frighten good
people from
running for the board, and I hope it won't.

It is, however, hard work and calls for dedication. We have that with our
boards, and they respond to our positions. They do not, however, have to agree
with us.
