A few years ago I had a case where my client's pit bulls got out and went to
the neighbor's house and left the pieces of their two pets strewn though out
the house, and then went home and went to sleep.
Animal Control held a hearing and ordered them destroyed. I got an
injunction and set a trial in the Superior Court. It was a five day court
trial,
(only a judge). The judge was the first Viet Nam judge in Orange County.
I used Bob Penny as an expert on behavior, and proved the dogs had been
fence fighting for years, and that was found to be provocation. The law said a
dog can be destroyed if they injure a person, or injure dogs without
provocation.
The dogs were returned with some severe restrictions. Bob was great. We
still talk about the trial.
