CALL TO ACTION-- CA SB 250

SB 250 will be heard on May 4th in the Senate Appropriations Committee. 
There is not much time to get letters to the Committee Consultant so action 
needs to be taken NOW. The amendments on April 21st still make this a ONE 
STRIKE and your are out type of bill. In other words, a permanent penalty for 
an one-time infraction and still does not address the issue pet owner who 
may con tribute to the pet population irresponsibly. It also creates a new 
crime by making it illegal to own an intact pet without a license. Current 
law states that all pets must be licensed but SB 250 specifically states 
that if you own an intact pet without a license, you are in violation of state 
law not just a municipal ordinance. The penalty for an infraction with 
current law would be for you to license your intact pet. SB 250 would require 
that you be cited for the infraction and therefore, ineligible for any 
intact licenses. The result-- all of your intact pets would be required to be 
sterilized.

Letters should focus on SB 250 setting a state mandate that would increase 
both local and state financial commitments in a time when there is a 
nationwide economic crisis. It would increase owner surrenders of animals 
because there are no provisions for low cost or no-cost spay/neuter of pets. 
Owners would be forced to surrender their pet because they cannot afford to 
alter them. We have seen this occur in Los Angeles and their most recent 
mandatory spay/neuter. SB 250 also sets a precedence of accepting a permanent 
penalty for what would otherwise be minor infractions. With only one strike, 
pet o wners have no recourse for natural disasters or accidents that occur 
where a pet might get loose and roam. Unlike traffic court, there is no 
judicial system set up to hear and argue animal citations unless it is criminal 
such as dog fighting, vicious dog attacks, and/or crimes against animals 
such as abuse and neglect. Therefore, there truly is no "day in court" to be 
found guilty of an infraction-- the citation is proof of your guilt.

ACTION TO TAKE: 

ORGANIZATIONS (clubs, rescue groups, etc.) must write to the committee 
members immediately - there is not much time! Send your letter BY MAIL to be
received by the Committee Consultant, Mark McKenzie. He will be preparing 
the bill analysis for the committee. Quantity of letters is important; Mr. 
McKenzie is the individual that fast-tracked AB1634. Right now all I have

committee too. 

BUSINESSES - If you own a business, also send a letter from the business. 
If passed, this will increase state liabilities through the Hayden Act.

1) Send your letters on Organization or Club letterhead. Mail or fax - 
hard copy is important. 

2) Reference the title - " Re: OPPOSE SB 250 as amended 4/21/09
An act to add Section 30804.6 to the Food and
Agricultural Code, relating to animals.

3) Begin your letter by stating that your club (state name) is OPPOSED to 
SB 250 as amended April 21, 2009. If you are an out of state club with 
members in California, please be sure to note that fact.

4) Don't worry too much about substance; the goal is to express your 
opposition. One page is ideal - 2 pages are OK. 

5) Put comments in your own words. Again, the CDOC website has some 
suggestions but form letters are not taken seriously. 

6) Conclude your letter by again stating your opposition to the Bill; 
thank the Senator for his/her time and ask for a NO vote on SB 250. 

IN ADDITION TO THE COMMITTEE, NOW IS THE TIME FOR ALL CALIFORNIANS TO 
BEGIN CONTACTING THEIR STATE REPRESENTATIVES TO EXPRESS YOUR OPPOSITION. Go to
