A rash of bills have been introduced by the  usual suspects in California. 
 Following is the posting by The Animal Council (theanimalcouncil..com), the 
best site for detailed analysis and most up to date of all.  Now that they are 
back from their "sabbatical" after AB1634 and the rest of the 2007-2008 bills, 
I'll be checking their website daily.  So should any Californian interested in 
bills relevant to animals.  Or you can go to www.carpoc.org... I'll be adding

*NEW CALIFORNIA BILLS THRU 2/10/09

NOTE: THE ANIMAL COUNCIL has been on sabbatical since August, 2008, 
suspending publication of the UPDATES but maintaining the website and 
blog. In reaction to the still ongoing fiscal and budgetary crisis 
in California government, Governor Arnold Schwarzenegger vetoed a 
number of the bills we had tracked in 2008, whether warranted or 
not. Reaching a new plateau in 2008, a number of organizations, both 
in and out of state, representing interests of animal owners spent 
hundreds of thousands of dollars on California legislation

another. In this milieu, we will continually reevaluate the best 
uses of our resources in this endeavor with focus on issue analysis, 
background material and law.

CALIFORNIA 2008 ELECTIONS increased the Democrat majority in the 
Assembly to 51-29 and retained the Senate majority at 39 with the 
District 26 seat vacant and the usual 15 Republican districts. With 
a number of unknown and untested new legislators and the recent 
history of intensive lobbying activity by the array of organizations 
mentioned above, strategies to block detrimental bills will likely be 
more elusive than ever, notwithstanding the budgetary politics and 
heavy-handed governor. Friday, February 27 will be the final day to 
introduce new bills. As new bills are introduced, they will be added 
to our 2009 tracking table which will be updated regularly with links 
to all bill documents.

Remember that California bills are often introduced in sketchy form 
with details added by the time of committee hearing and thereafter. 
For this reason, bills not otherwise requiring active opposition, 
should simply be monitored as they progress and true parties and 
interests revealed. 

CA AB 107, introduced January 12 by Assembly Members Cathleen 
Galgiani (D-17) of Tracy and Connie Conway (R-34) of Visalia (Bill 
Maze's old seat) picks up where the vetoed 2008 AB 1760 left off as 
to slightly more lenient licensing for out of state veterinarians, 
changes to the Veterinary Medical Board and changes in discipline of 
Registered Veterinary Technicians.

ASSEMBLY CONCURRENT RESOLUTION 19 by Assembly Member Cameron Smyth (R-
38) of Granada Hills is this year's Spay Day USA declaration of 
February 24 as Spay Day USA, based on the usual and sometimes dubious 
list of findings.

CA AB 233 introduced February 5 by Assembly Member Cameron Smyth (R-
38) of Granada Hills would for taxable years beginning on or after 
1/1/10, and before 1/1/15, allow a deduction for the qualified costs, 
i.e. adoption fee not in excess of $300, paid or incurred during the 
taxable year by a taxpayer for the adoption of pets from a qualified 
animal rescue organization, i.e. public animal control agency or 
animal adoption organization tax exempt under IRC Sec. 501(c)(3).

CA AB 241 introduced February 10 by Assembly Member Pedro Nava (D-35) 
of Santa Barbara follows the alarming trend in a number of other 
states this year with the "Responsible Breeder Act of 2009"adding a 
new section 597.8 See AB 243 below) to the Penal Code ascriminal 
regulation of dog and cat breeders. While this would create a new 
crime with some inherent fiscal obstacles, it bypasses the trap of 
mandating new civil regulation by either a state or local agency. AB 
241 creates a new misdemeanor criminal offense prohibiting anyone who 
buys or sells dogs or cats from owning, possessing, controlling or 
otherwise having charge or custody of more than a combined total of 
50 dogs and cats with intact sexual organs. Excesses are subject to 
seizure, sterilization, disposition or euthanasia and suspected 
premises are subject to inspection. Veterinary facilities, pet stores 
and research institutions are exempted. 

CA AB 242 introduced February 10 by Assembly Member Pedro Nava (D-35) 
of Santa Barbara would amend Penal Code Section 597.5 elevating 
defined dog fighting offenses from misdemeanor to felonyand 
increasing state prison terms as mandated rather than alternative to 
a fine, remaining at cap of $50,000. Nava has previously been 
interested in this type of bill, not acceptable to the Legislature 
given the multiple constraints on the existing prison population. 

CA AB 243 introduced February 10 by Assembly Member Pedro Nava (D-35) 
of Santa Barbara would amend Penal Code Section 597.1, enacted as a 
mandate rather than county elected option with the 1997 Hayden bill, 
SB 1785, to delete a paragraph covering post-adjudication provisions 
and enacting a new Penal Code Section 597.8 (would require re-
numbering if this and AB 241 both enacted) to mandate a number of 
post-conviction (designated offenses) restrictions on owning or 
caring for animals, classified as "contempt of court" as misdemeanor 
offenses and forfeiture of any animals involved. This wouldremove 
all judicial discretion as to these post-conviction issues, and as 
introduced, deletes the provisions for return or disposition of 
animals following acquittal or non-conviction.
