HOUSE BILL 148

AN ACT to amend Tennessee Code Annotated, Title
44, Chapter 17, Part 1, relative to dealers who breed
certain animals for sale or resale.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE
OF TENNESSEE:
SECTION 1. Tennessee Code Annotated, Section
44-17-102(4), is amended by inserting the following
language in the definition of "Dealer" after the
language "means any person who, for compensation or
profit,": breeds for sale more than one (1) litter of
pups annually or
SECTION 2. Tennessee Code Annotated, Section
44-17-104(b), is amended by deleting the language
"Dealer license fee (retail) to buy dogs or cats for
resale" and by substituting instead the language
"Dealer license fee (retail) to buy dogs or cats for
resale or for selling more than one (1) litter of pups
annually."
SECTION 3. Tennessee Code Annotated, Section
44-17-106, is amended by deleting the language "Dealer
license fee (retail) to buy dogs or cats for resale"
and by substituting instead the language "Dealer
license fee (retail) to buy dogs or cats for resale or
for selling more than one (1) litter of pups
annually."
SECTION 4. Tennessee Code Annotated, Title 44,
Chapter 17, Part 1, is amended by adding the following
language as a new section to be designated as follows:
44-17-123. The space provided on the premises of a
dealer who breeds for sale more than one (1) litter of
pups annually must be not less than 10' x 10' per
adult dog.
SECTION 5. This act shall take effect July 1,
2005, the public welfare requiring it.
