What do you all think?

Jan, since it was my photo that seems to have started some of this,
and since I've been following the thread with interest, I thought I
might weigh in.
First, I think some of the legal issues have been dealt with by others.
Second, I almost always ask, or I'm in a situation where everybody
knows that "Ken is out with his camera, again." This is true
especially of my congregation series.
Third, my family members do enjoy seeing themselves in photographic
ways that they do not normally see; i.e., they see themselves in
black and white and, if Im lucky, they see themselves in striking
poses, with striking expressions, and they like it.
Fourth, yes, it does take some self-confidence (some would say
"chutzpah"), and that is part of being a photographer. AND, it helps
to cultivate, or have, a genuine interest in the people you are
photographing. If they know they are being observed with care and
interest, they usually respond that way.
Peace,
Ken
