Mr Hemphill was trying to get into the neighborhood last night when I was
pulling in from work at about 5 30. I drove by and let him in automatically
and he followed me to my house and into my driveway. He said he was trying
to come in and talk to any neighbors that would listen about his new plan.
I took him to my backyard and showed him how close his development would be
to us, the Pipers, and the Whiting’s.

He said his plan was to withdraw his first proposal and come back with a
second proposal much smaller than the first, eliminating all boat and RV
storage, and only be a few hundred feet from the road with a wooded buffer
along several hundred feet from our properties m. He asked if he thought
the neighborhood would be more receptive of this and I said no, we would
not want this type of development on this property at all.

I told him he would have a hard time getting anything passed, as we would
continue to fight it.

I asked if he would be interested in selling the land and he said he would
let me know about that tomorrow.

So maybe there is a way out of this completely.

Anyone feel free to call me and discuss this further as well.

This is what I replied to Bill yesterday concerning the application:
"It's true Bill that the contract would be contingent on the rezoning.
But, he's spent several thousands of dollars in engineering, survey,
drafting, and application fees. I did this 15 years ago on a property on
Friendship Rd. in Buford. It was expensive then and I'm sure prices have
increased. You are correct that Earnest Money would be returned if rezoning
isn't granted, but his other expenses would be gone. Also, he views this as
a profitable venture. He'll give it his best shot."

I will stand with whatever other members feel is the best course of
action, but I think we SHOULD meet with Hemphill just to determine what
he's going to pitch to the County Commission, because he surely will. If we
know in advance what he will propose we could provide a better counterpoint
to his modified proposal. Just my thoughts, and again, I will agree with
whatever Subd. decides.

I have not received any communication from Mr Hemphill, and honestly, I
don’t feel there is anything he can do to change my mind on not wanting
storage facility on that property.

The Hall County Planning Commission voted 4-1 to deny his proposal.
Sounds like he is trying to win over Riverwalk and get our support in order
to move forward.  Very doubtful he can win me over if he still wants to
build on that lot.

Planning commission details aside, is there anything that Mr. Hemphill
can say to us right now that would make us want a storage facility backing
up to our neighborhood?

My thoughts are, we fight this tooth and nail until we have no options,
then we consider negotiating with Mr. Hemphill. I don't want to encourage
him to carry this fight forward by making concessions now.

Just to clarify, the Planning Commission has RECOMMENDED  denial 3-1.
The County Commission has final say on the matter. There have been
instances where the Commission gave approval AGAINST the recommendation of
the Planning Commission when they voted for denial 4-0.  I'm sure Mr.
Hemphilll will bring all his ammo to the Commission meeting in April. As we
know, he's already invested a considerable amount of money on this project
and he will use any, and all angles to accomplish his goal. It's important
to be even more vigilant and active now than before. Just my thoughts.

The council already denied his request, wondering why we would entertain

to meet with the commissioners but that they should lean heavily on the
advice of the council, correct? We are on board with however the majority
want to proceed. But seems to me he is dead in the water and trying to get
us on board and honestly is there anything he could change to make us in
favor of this?

Hi neighbors,

Attached is a voicemail that I received on my phone this afternoon from
John Hemphill trying to reach Chris concerning the 7 acres behind us.  I
thought you all needed to hear it.  Chris has not responded to him because
he’s still working.

Thanks,
