Dear Lovers of the Land,



Last Friday, on March 11, 2016, *FERC* issued the permit, called a
Certificate of Public Convenience and Necessity, to Tennessee Gas (TGP/KM)
for its *CT Expansion Project*. The gas is slated for CT users, but the *Otis
State Forest *in Sandisfield, MA, including Spectacle Pond (shown above),
would be impacted by *2 miles* of construction for a loop in the pipeline
to be used for underground storage in the state forest near the pond. The
affected land, as part of a *900-acre* project, was conveyed by *Mass
Audubon *to the Commonwealth in 2007 for conservation purposes only. Mass
Audubon opposes the use of the land for this non-conservation, pipeline
purpose.



The outcome of this litigation will have a direct bearing on fate of the 
*100-200
publicly and privately conserved properties in Massachusetts* that are in
the path of the proposed 400-mile *NED Project* and its pipelines,
pipeyards, workspaces, access roads, and other infrastructure. On Wednesday
of this week, March 16, 2016, the Otis State Forest *Article 97 Bill*
(H.3690) filed by Rep. Garrett Bradley of Plymouth County was released out
of committee for further study, meaning it would *not be voted on* during
the current legislative session that ends on July 31, 2016. The following
day, March 17, 2016, TGP’s 150-page complaint and accompanying documents
were filed.



A hearing on the matter in Berkshire Superior Court is currently scheduled
for March 30, 2016 at 10am.

“This is a civil action for:

               (a) the *condemnation* of permanent and temporary
easements *under the power of eminent domain*;

(b) ancillary injunctive relief *to allow immediate entry and possession
of the easements*; and

(c) the ascertainment and *award of just compensation* to the
Commonwealth of Massachusetts (the "Commonwealth"), acting by and through
its *Department of Conservation and Recreation* ("DCR").”
