I did a little research on the DPU website to find out what they said about
notification of landowners in the event of eminent domain taking for
surveying. The website referred to these MGL statutes:
MGL Chapter 164 Section 72A. The department may upon petition authorize an
electric company to enter upon lands of any person or corporation for the
purpose of making a survey preliminary to eminent domain proceedings. The
department shall give notice of the authorization granted, by registered
mail, to the landowners involved at least five days prior to any entry by
such electric company. The company entering upon any such lands shall be
subject to liability for any damages occasioned thereby, to be recovered
under chapter seventy-nine.
Section 75D. The provisions of section seventy-two A shall be applicable to
natural gas pipe line companies.
There are other regs pertaining to eminent domain for constructing the
pipeline but we aren't quite at that stage yet.
If I were an evil corporation, I would send out a blanket notice to all the
property owners giving the 5 day notice but not specifying exactly when I
would be arriving. In other words, I don't think we can count on getting
notification on the day of the survey.
I am heading to the Holleran occupation site in Pennsylvania on Thursday
this week. Some local folks from the Sugar Shack group are there now. I
hope to get more info about how they are organizing and what they have run
into so far. A person told me today that they are expecting a contempt of
court ruling at any time. Here is a short article on that situation.
