And, since foolishness abounds, let me point out that the footnote below is 
dicta, as it wasn't issued by the FCC and was in an advisory report to 
Congress, not a decision per se. 

However, the FCC Record cite 16 FCC Rcd 2598, 2643 (2001) is most likely not 
dicta.
