Back in Detroit on MediaOne->AT&T->Comcast (same cable subscription) I could get one channel of HBO as something like channel 5 analog for the longest time, maybe 10-20 years without subscribing to anything more than (extended?) basic cable. Because of the channel placement I had to assume it was on purpose and they knew about it. Whatever reason, maybe that carries over to digital.

What is gained -- at least in the case I'm most recently familiar with -- is the clear QAM receiver permits analog customers on Cox Cable San Diego (their largest system) to get many DIGITAL channels, all local channels, and one channel of HBO for NO additional cost. I think there's a good case for encrypting the Hallmark Channel and other mini-pays, but to not encrypt all channels of HBO is something that I have no doubt violates the HBO contract with Cox.
