I have been pushing buttons on my phone to renew prescriptions for years,
first at Duane Reade, then Walgreens (which took them over), and now CVS. I
enter my prescription number, and then I push the key that confirms I want a
renewal.

I stand corrected. I’ve been renewing prescriptions online for at least 15
years. Never used a phone to do this. I will say that it is common for the
pharmacies to call and inform my wife that she has a refill.
This does raise the question of the difference between voice telephony and a
computational transaction enabled via a phone. There is a wealth of history
here, including the 2002 FCC decision to eliminate the requirement that the
telcos make their data lines available to competitors. This led to the 2005
Supreme Court NCTA vs Brand X decision.
The attempt by Judge Millett to equate using a phone to order a prescription
refill with using a website was rather lame. Yes, we can do some rudimentary
data processing tasks over the voice network. We can even hook up slow acoustic
modems and access the Internet. The world has moved on...
