The title of the article is a bit misleading, but this should put to rest the question of whether HTML5 will now adopt h.264 for the standard.

It is important to note that there is still a royalty on decoders that are embedded in an operating system, like Windows or OS-X, or in other IT based products. But this has always been true for h.264, and the relatively low annual cap on this royalty - now $6.5 million per year - has proven to be a viable solution.
