I seem to recall that a couple of years ago the FCC ruled that cable
companies could reduce the bandwidth of broadcast HDTV programs so long as
they were not of lesser quality than the non broadcast HDTV channels carried
by cable.

I believe that satellite recently received special dispensation based upon
their current limited bandwidth but I don't know the details.
